Brian Chau, Director of the Alliance for the Future, has voiced strong opposition to the proposed California senate bill that seeks stringent regulation on AI development. Chau argues that the bill, which aims to create a new regulatory body dubbed the Frontier Model Division (FMD), unfairly targets smaller AI developers and open source projects by setting regulatory benchmarks based on computing power equivalent to or similar to that of industry leaders like OpenAI’s models.
The bill mandates that any AI model with a computational power or performance similar to that of a model using 10^26 floating-point operations per second (FLOPs) falls under its purview. Chau criticizes this measure as overly broad, claiming it could include models that merely exhibit similar capabilities to OpenAI’s GPT-5, if it were to reach that computational threshold. This could potentially cover a wide array of AI technologies that are not directly comparable in scale but are similar in performance metrics.
The Regulatory Burden
Moreover, the bill proposes funding the FMD through fees imposed on the very companies it would regulate. Chau views this as an unjust financial burden on AI innovators, particularly smaller startups, who would be funding regulatory measures that could disadvantage them in the market. Additionally, he highlights the perilous legal implications for developers, noting that the bill makes it a felony to commit paperwork errors in compliance reports required by the FMD, an aspect he argues could be used selectively to target specific firms or individuals.
